Terms of Service

1. Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and SafeKid AI Ltd ("Company"), governing your access to and use of the SafeKid AI platform, API, and related services. By creating an account or using our services, you agree to these Terms. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Services

SafeKid AI provides AI-powered content moderation and safety analysis services for educational technology platforms, schools, and families. Our services include:

• Content Safety Analysis API for programmatic integration
• School Safety Dashboard for monitoring and safeguarding
• Parent Transparency Portal for family oversight
• Compliance Reporting Engine for regulatory evidence
• Behavioural Pattern Intelligence for early intervention

3. Accounts & Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. API Usage

API access is governed by your subscription tier. You must keep API keys confidential and not share them with unauthorised third parties. Rate limits apply per your plan. We reserve the right to throttle or suspend API access for abuse, including but not limited to: reverse engineering our safety models, submitting content designed to circumvent moderation, or exceeding documented rate limits.

5. Data Processing

When you use SafeKid AI to process student or child data, you remain the data controller. We act as a data processor under a Data Processing Agreement (DPA) available at Data Processing Agreement. You are responsible for ensuring you have the appropriate legal basis to submit personal data to our platform.

6. Safeguarding Obligations

SafeKid AI provides tools to assist with safeguarding but does not replace professional safeguarding judgement. Schools and DSLs remain responsible for fulfilling their statutory safeguarding duties under Keeping Children Safe in Education (KCSIE). Our alerts and analysis are advisory and should be used alongside established safeguarding procedures.

7. Intellectual Property

All intellectual property rights in the SafeKid AI platform, including our safety models, algorithms, user interface, and documentation, belong to SafeKid AI Ltd. You retain ownership of content you submit for analysis. We do not use submitted content to train our models.

8. Limitation of Liability

To the fullest extent permitted by law, SafeKid AI's total liability under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes liability for death, personal injury caused by negligence, or fraud.

9. Termination

Either party may terminate these Terms with 30 days' written notice. We may suspend access immediately for material breach. Upon termination, we will provide a data export within 30 days and delete your data within 90 days unless retention is required by law.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect via email or in-app notification. Continued use after the effective date constitutes acceptance.
